When he was President George W. Bush’s deputy attorney general, James Comey was the figure who authorized one of that administration’s biggest scandals — the warrantless wiretapping fiasco — and followed up by approving a legal memorandum in 2004 espousing the theory of radical expansion of executive powers. To be fair, Comey was also one of the few in Bush’s Justice Department who threatened to resign if Bush hadn’t minimally modified the warrantless wiretapping program. And Comey personally went to then-Attorney General John Ashcroft‘s hospital bed to prevent Alberto Gonzales and Andy Card from strong-arming Ashcroft into legalizing the warrantless wiretapping program.

As Glenn Greenwald, writing for the Guardian notes, “In other words, there was something the NSA was doing for years — that we still don’t know — even more extreme than the illegal NSA program revealed by the NYT in 2005.”

Now Comey’s President Barack Obama’s nomination to head the US Federal Bureau of Investigation (FBI) because, well, you know, revolving doors and all of that.
